The Owners, Strata Plan 92888 v Taylor Construction Group Pty Ltd and Frasers Putney Limited [2019] NSWCAT

The Owners sought an order that the cladding to their building be replaced because it was not fit for purpose and did not comply with applicable codes and standards.

HELD:

– the cladding did not comply with applicable codes and standards;

– the cladding presented an undue risk of the spread of fire

– the cladding material was not fit for the purpose for which it was used.
